These terms apply to Recap: the Recap desktop apps for Mac and Windows, and Recap Cloud, the service at recap.ampersand.ch that hosts and shares your videos. Recap is provided by Ampersand Labs by Davide Morotti (“we”). By creating an account or using Recap you agree to these terms.
1. The desktop apps
The desktop apps are free. Recordings are saved on your computer and stay there unless you connect a Recap Cloud account and upload them. The apps check GitHub for new versions.
2. Your account
- You need to be at least 16 years old to create an account.
- Give us a working email address and keep your password safe. You're responsible for what happens in your account.
- Watching a shared video doesn't need an account. Commenting does.
3. Recap Cloud subscription
- Uploading videos and creating share links needs a subscription: CHF 12.00 a month, including 100 GB of storage. Storage above that costs CHF 0.15 per GB per month, measured once a day and charged in proportion to the days you use it.
- Prices exclude VAT and other sales taxes. These are calculated from your billing address and added at checkout and on each invoice. Businesses can enter a VAT ID where the reverse-charge rules apply.
- The monthly fee is charged in advance; extra storage is charged at the end of each month. Payments are processed by Stripe. If a payment fails, uploads are paused until it succeeds.
- We may change prices with at least 30 days' notice by email. The change applies from your next billing period, and you can cancel before it takes effect.
4. Cancelling, and what happens to your videos
- You can cancel any time in Settings › Billing. You keep uploading until the end of the period you've paid for. Fees already paid aren't refunded.
- When your subscription ends, whether you cancelled or a payment couldn't be collected, your videos and share links keep working for 30 days. We email you when the subscription ends and again at least 7 days before deletion. After that, your uploaded videos are permanently deleted. Subscribe again before then to keep them.
- Your account itself stays open. Recordings saved on your computer aren't affected.
- You can delete your account in Settings › Profile. This deletes your videos immediately and ends your subscription, with a final invoice for extra storage used so far.
5. Your content
- You keep all rights to the videos, comments and other content you upload.
- You allow us to store, copy and stream your content to the people you share it with, only as needed to run Recap. This permission ends when the content is deleted.
- Anyone who has a video's link can watch it, unless you set it to “Only me”. You decide who gets your links and whether viewers can download the video.
- Make sure you're allowed to record and share what's in your videos. That includes other people's voices and faces, and anything confidential on your screen.
6. Acceptable use
Don't use Recap to:
- share anything illegal, including content that infringes copyright or other people's privacy;
- harass, threaten or mislead people, or share sexual content involving minors or any non-consensual intimate content;
- distribute malware, send spam, or use Recap as general file hosting unrelated to video messages;
- interfere with the service, get around its limits, or access other people's accounts or videos without permission.
We may remove content or suspend an account that breaks these rules, and will tell you why unless the law prevents it. To report a video, email legal@ampersand.ch.
7. Availability and changes
We work to keep Recap running and your videos safe, but we can't promise uninterrupted service. Keep your own copy of anything important; the desktop app saves every recording on your computer. We may improve or change features. If we ever shut Recap Cloud down, we'll give you at least 60 days' notice to download your videos.
8. Liability
To the extent permitted by law, we're liable only for damage caused intentionally or through gross negligence. We're not liable for indirect damage, lost profits or lost data. Nothing in these terms limits rights you have as a consumer under mandatory law.
9. Changes to these terms
If we change these terms in a way that matters to you, we'll email you at least 30 days before the change applies. If you don't agree, you can cancel or delete your account before then.
10. Law and jurisdiction
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The courts at City of Zürich, Switzerland, have jurisdiction. Consumers can also go to the courts where they live, where mandatory law allows it.
